Its a sad day in our household. Thor was 13 1/2 years old and there was never a better more loyal dog. It seems like yesterday when the boys were little and he would stand on his hind legs and steal their hats off their heads. Though it hurts terribly to lose him, his love and those puppy dog eyes will be with us forever.

My parents' dog almost died from strep throat, thanks to a misdiagnosis by a veterinary neurologist who was treating the animal
for a brain tumor. One day the German shepherd was listless and had a poor appetite, eyes glazed, not very responsive to commands.

The ER vet at a prestigious veterinary clinic where the neurologist worked examined the GS and couldn't come up with anything definitive; the animal stayed overnight, and next morning and $1,300 later, we were informed by the vet neuro that the deterioration was from the brain tumor's fluid buildup and/or the tumor itself, a "bad" day for the dog, par for the course; the animal was treated with a diuretic and anti-inflammatory via IV feed.

The GS was perked up somewhat for the next eight hours, then relapsed, and for the next five days, outright deteriorated: increasing loss of appetite; increasing listlessness; increasing weakness; increasing sleep; glazed look in eyes; depressed disposition.

Our pet was eventually sleeping at all times except when the urge to relieve himself was so overwhelming that he forced himself up and stood by the door; he was also lapping up huge amounts of water.

By then, this beloved German shepherd had had one visit with a new veterinarian in Colorado who uses alternative treatments for cancer. Over the phone at 10 pm I described the dog's symptoms to this doctor, and he promptly diagnosed strep throat!

"Bring him in tomorrow morning at 7:30," he said. Next morning the GS had a fever of over 104 degrees. Our pet stayed a few days and was "rebuilt," explained the doctor, adding that he sees strep throat in dogs all the time.

General symptoms of strep throat in dogs: lethargy; a depressed demeanor; physical weakness; glazed, glossy or foggy eyes; loss of appetite/slower eating; increased water intake, though lethargic lapping it up; fever; unwillingness to get up at commands; increasing sleep to the point of even literally sleeping every moment save for getting up to urinate or get water.

A wild wolf chase ended, apparently happily, in the New Brighton Thursday morning.

A staff member from the science center from which it escaped shot the animal with a tranquilizer dart about 9:30 and captured it in a net in New Brighton, where it had been spotted in the early morning hours. The animal appeared to be the wolf that had been on the run for four days.

Hello! I'm Renee. I came to Animal Ark, with my two puppies, from the Red Lake Reservation. My previous guardian surrendered us because they couldn't provide us with food. So I've been enjoying life at the shelter, with regular meals every day! I am a very sweet lady who loves any attention that can be spared. The shelter doesn't have very much of a history on me, but I am very smart and try my best to earn treats! I am going through treatments for heartworm, but also tested positive for lymes, anaplasmosis and erlichia, as well. I need to be kept fairly quiet throughout the treatment process and cannot go home or accept visitors until I'm better. When Kathy spotted an emaciated Rottweiler along the side of a highway in Tennessee, she realized that there was something different about "Ella." Ella was friendly and eager for attention -- behavior that is unusual for either a stray or an abused animal. She had clearly been loved by someone.

In the wooded area just off the highway, Kathy discovered a "nest" where Ella had been sleeping (pictured here). It was strewn with someone's personal items, including a toothbrush, razor, comb and candle.

Then Kathy remembered something crucial. A few weeks earlier, a terrible car wreck had taken place on the highway... very close to where Ella had made her makeshift home. Kathy contacted the state's highway patrol and learned that a family had been in the car, and that they all survived.

Rescuers had never seen Ella, who had likely been thrown from the car. The dog foraged on her own for a few weeks, drinking from a drainage ditch and patiently waiting for beloved family members who thought their special pet was dead!

American Humane stepped in when they learned that the family's medical bills had caused tremendous financial strain. The money they had set aside for a new home had to be used for medical bills instead. When they have millions of squads on the streets driving around, one couldn't have stopped or driven over to the shelter(s) once a day to see if the little guy had arrived at one? No one could spare a few seconds (disconnecting themselves from the internet and DVD's they watch in their patrol cars) to see if he arrived at a shelter? Clearly no one gave a crap about this poor guy who was there for one purpose - to back them up and serve them. Sad.

Soaked With Gasoline, Set Ablaze and Left to Die

It’s hard to believe that someone could heartlessly douse a helpless animal in gasoline and then set him on fire.

But that is exactly what happened to poor Hadley, an 18-month-old cat who tragically crossed paths with the wrong person while he was wandering his neighborhood in Kent County, Mich.

Hadley’s owners were horrified when their pet, who frequently spent time outdoors, somehow found his way home covered in third-degree burns. Raw, exposed flesh marred his ears, neck, legs and back, where large chunks of once-beautiful orange fur were completely gone. We can only imagine how much pain he must have been in!

Unfortunately, no one knows who perpetrated this malicious act. Authorities hunted for suspects, but were unable to find any. Meanwhile, Hadley’s family couldn’t afford the suffering cat’s expensive medical care. Desperate to ensure that he received help, they relinquished Hadley to a local animal shelter.

Hadley’s Second Chance

When Maj. Brian Dennis of the United States Marine Corps met a wild stray dog with shorn ears while serving in Iraq, he had no idea of the bond they would form, leading to seismic changes in both their lives. "The general theme of the story of Nubs is that if you're kind to someone, they'll never forget you -- whether it be person or animal," Dennis tells Paw Nation.

In October 2007, Dennis and his team of 11 men were in Iraq patrolling the Syrian border. One day, as his team arrived at a border fort, they encountered a pack of stray dogs -- not uncommon in the barren, rocky desert that was home to wolves and wild dogs.

"We all got out of the Humvee and I started working when this dog came running up," recalls Dennis. "I said, 'Hey buddy' and bent down to pet him." Dennis noticed the dog's ears had been cut. "I said, 'You got little nubs for ears.'" The name stuck. The dog whose ears had been shorn off as a puppy by an Iraqi soldier (to make the dog "look tougher," Dennis says) became known as Nubs.

Dennis fed Nubs scraps from his field rations, including bits of ham and frosted strawberry Pop Tarts. "I didn't think he'd eat the Pop Tart, but he did," says Dennis.

At night, Nubs accompanied the men on night patrols. "I'd get up in the middle of the night to walk the perimeter with my weapon and Nubs would get up and walk next to me like he was doing guard duty," says Dennis.
The next day, Dennis said goodbye to Nubs, but he didn't forget about the dog. He began mentioning Nubs in emails he wrote to friends and family back home. "I found a dog in the desert," Dennis wrote in an email in October 2007. "I call him Nubs. We clicked right away. He flips on his back and makes me rub his stomach."

"Every couple of weeks, we'd go back to the border fort and I'd see Nubs every time," says Dennis. "Each time, he followed us around a little more." And every time the men rumbled away in their Humvees, Nubs would run after them. "We're going forty miles an hour and he'd be right next to the Humvee," says Dennis. "He's a crazy fast dog. Eventually, he'd wear out, fall behind and disappear in the dust."

On one trip to the border fort in December 2007, Dennis found Nubs was badly wounded in his left side where he'd been stabbed with a screwdriver. "The wound was infected and full of pus," Dennis recalls. "We pulled out our battle kits and poured antiseptic on his wound and force fed him some antibiotics wrapped in peanut butter." That night, Nubs was in so much pain that he refused food and water and slept standing up because he couldn't lay down. Dennis and his team left again the next day, but Dennis thought about Nubs the entire time, hoping the dog was still alive.

Two weeks later, when Dennis and his team returned, he found Nubs alive and well. "I had patched him up and that seemed to be a turning point in how he viewed me," says Dennis. This time, when Dennis and his team left the fort, Nubs followed. Though the dog lost sight of the Humvees, he never gave up. For two days, Nubs endured freezing temperatures and packs of wild dogs and wolves, eventually finding his way to Dennis at a camp an incredible 70 miles south near the Jordanian border.

"There he was, all beaten and chewed up," says Dennis. "I knew immediately that Nubs had crossed through several dog territories and fought and ran, and fought and ran," says Dennis. The dog jumped on Dennis, licking his face.

Most of the 80 men at the camp welcomed Nubs, even building him a doghouse. But a couple of soldiers complained, leading Dennis' superiors to order him to get rid of the dog. With his hand forced, Dennis decided that the only thing to do was bring Nubs to America. He began coordinating Nubs' rescue effort. Friends and family in the States helped, raising the $5,000 it would cost to transport Nubs overseas.

Finally, it was all arranged. Nubs was handed over to volunteers in Jordan, who looked after the dog and sent him onto to Chicago, then San Diego, where Dennis' friends waited to pick him up. Nubs lived with Dennis' friends and began getting trained by local dog trainer Graham Bloem of the Snug Pet Resort. "I focused on basic obedience and socializing him with dogs, people and the environment," says Bloem.

A month later, Dennis finished his deployment in Iraq and returned home to San Diego, where he immediately boarded a bus to Camp Pendleton to be reunited with Nubs. "I was worried he wouldn't remember me," says Dennis. But he needn't have worried. "Nubs went crazy," recalls Dennis. "He was jumping up on me, licking my head."

Dennis' experience with Nubs led to a children's picture book, called "Nubs: The True Story of a Mutt, a Marine & a Miracle," published by Little, Brown for Young Readers. They have appeared on the Today Show and will be appearing on The Tonight Show with Conan O'Brien on Monday.

Was it destiny that Dennis met Nubs and brought him to America? "I don't know about that," says Dennis. "It's been a strange phenomenon. It's been a blessing. I get drawings mailed to me that children have drawn of Nubs with his ears cut off. It makes me laugh."

A tough girl named Sam: Dog shot in the face has new home in Ellsworth, Wis.

Samantha is one lucky dog.

You wouldn't know it, though, if you saw her Aug. 11. Someone had shot her in the face and left her to die inside a locked mobile home in Ellsworth, Wis.

But lucky for Samantha, police came knocking that day.

Bloody dog prints outside the home were a sure sign something was wrong. Doug Ducklow, an investigator for the Pierce County sheriff's office, had gone to the home to follow up on an unrelated case when he found the blood. Looking through a window, he couldn't believe what he saw: a skinny dog with part of its lower jaw hanging from its face.

"I knew right away that I had to do something to rescue that animal," Ducklow said. He got a warrant to enter the home and contacted Dr. Becky Behrendt

at Pierce Veterinary Clinic in Ellsworth.

The frightened dog was taken to the clinic, and Ducklow anticipated the worst.

"I thought for sure that they'd have to euthanize the dog," he said. "But Becky looked at me and said, 'No, I think we can save her.' "

They did.

The next month, clinic staff performed multiple surgeries on Samantha at the clinic's expense and repaired as much of the damage as they could.

"One side of its lower jaw was pretty much gone, and the other side was broken," Behrendt said. "We fixed the side that was broken and kind of closed the side where the pieces were gone."

Dr. Heather Fairbairn, another veterinarian at the clinic, said the decision to save the dog was made because she demonstrated remarkable character.

"This dog had an extraordinary temperament given the situation," said Fairbairn, who added the dog showed no aggression. "All she wanted to do was lay her bloody face on someone's lap."

The day Samantha was found, Kim Tapager drove to the Pierce Veterinary Clinic to pick up a prescription for one of her two Great Danes. She had been thinking about adopting another one.

Clinic staff asked Tapager if she wanted to take the injured dog, which was sedated and unconscious. It wasn't a Great Dane, but it needed a home.

"I said, 'Well, you fix her up, and we'll take her,' " said Tapager, who lives in Ellsworth with her husband, Larry. "We planned on just fostering her, but we think she'll stay forever now."

Tapager, who calls Samantha "Sam" for short, said she gave the dog the name because "it sounded like a girly but tomboy-ish name."

"She's a tough girl," Tapager said.

Behrendt is happy where Samantha landed.

"She's a very good owner, so she'll take good care of her," Behrendt said of Tapager.

Tapager, who once worked in a veterinary clinic, has a hard time understanding why someone would do what they did to the dog, which is believed to be a 1 1/2-year-old German shepherd mix.

"They shoot her and leave her to suffer. ... I don't understand what's wrong with people," she said. "People who do that to animals — it's not far off from doing it to humans."

Staff at Pierce Veterinary Clinic determined Samantha, who came into the clinic without a name, had been shot within 24 hours of being found by Ducklow.

The sheriff's office later contacted Crystle Beckler, 24, and Kyle Hines, 23, who had been living at the mobile home. Beckler admitted she was the dog's owner, and she and Hines expressed surprise that something had happened to it, investigators said.

They said that when they left the dog in the home it was uninjured and had plenty of food and water. Although they had already vacated the home, Beckler told investigators there were plans for her or a relative to return for the dog, police reported.

Hines suggested to investigators that a neighbor could have shot Samantha. Both assured police they had nothing to do with injuring the dog, according to the report.

It was never verified that Beckler was the true owner because the dog had never been registered, Ducklow said.

A message left with Beckler was not returned Thursday, and Hines could not be reached for comment.

Police have not been able to determine who shot the dog, and no charges have been filed, said Ducklow, who called investigation into the shooting "stalled out."

"They're a defenseless animal," Ducklow said. "I'm extremely disappointed in how this all transpired."

Despite what has been done to her in the past, Samantha doesn't hold back in showing love to humans. She can be slow to warm up to some men, but once she does, she isn't afraid to give her unusual sideways kiss.

"She loves to sit on your lap and crawl on you," Tapager said. "It's amazing — you'd never know anybody did anything to her."

Because of nerve damage in her face caused by the gunshot, Samantha sticks her tongue out the side of her mouth when trying to lick something in front of her. Her tongue also tends to hang through her missing teeth and out the side of her face.

Samantha must be hand fed, and it's not clear if she will ever be able to eat on her own, said Tapager, but another possible surgery and some dental work should correct some of the problems.

The injury isn't enough to spare chew toys, though. Tapager said Samantha is a "toy freak."

The dog has gained several pounds since coming to her new home and looks much fuller than when she arrived. She spends her days playing with the dogs and cats of the Tapager home and going for walks in the countryside.

"She's a really happy dog," Tapager said. "She's wonderful, and we love having her."

You can also give your kids up for adoption or … read more turn them over to the state if you can't afford to feed them. But seriously joejoe, this is small minded and wrong. It doesn't sound insensitive, it is, and you're not sorry. You don't have to state the painfully obvious to those facing these types of decisions. The real point here is that if these pets are given up they are going to a shelter...so there is still a cost. Why not donate a small amount to keep a pet in a home? There are hundreds of studies showing the benefits that pets bring, especially in times of stress and particularly to children. I am sure we will see tons of negative comments here as the TROLLS come out to play this morning, and I can guarantee you that no one making negative comments in regard to this volunteers or truly supports helping anyone but themselves. The only negative comments are going to be from the normal group who hates it anytime someone gets a hand up, and those in the 'pets are property (things)' group. One day your life will pass before your eyes, make sure there is something there worth watching.

Kim Carrier drove up to the donation entrance of a St. Paul food shelf this week in a car piled high with bags of dog food. Her unusual gift reflects her unusual mission: to create Minnesota's first network of pet food shelves.

"I sometimes work at a pet supply store, and people laid off would call and ask if there is any place to get free pet food,'' said Carrier, of Minneapolis.

"I Googled and never found anything,'' she said. "So I decided to try to do something myself, and then a lot of other people jumped on board.''

Carrier launched the Pet Project in July. It's part of a fledgling movement nationally to make sure people don't have to choose between keeping food in the kitchen or Fido in the living room.

With more than 200,000 Minnesotans laid over the past year, plus the elderly and disabled on fixed incomes, the pool of Minnesotans who could benefit is enormous, said Carrier.

But to date, pet food donations have been limited to sporadic drives by charities, pet food stores or humane societies, said local humane societies.

"It's great that people do fundraisers a couple times a year, but your dog or cat needs to eat all year,'' said Carrier, who on this day dropped off 500 pounds of pet food at the Hallie Q. Brown Community Center food shelf in St. Paul.

Do you believe in canine guardian angels and the kindness of strangers? You just might after reading this story.

Early one morning, Yolanda Segovia's neighbor, Stacey Savige, knocked on her door and asked her to temporarily take in a stray dog she had found. The scruffy terrier mix had no collar or microchip. Segovia eyed the pooch -- burrs sticking to his belly and mud caking his fur -- and reluctantly agreed to foster him for the day.

An erstwhile hairdresser, Segovia hasn't worked since 2006. At 47, she is a survivor of breast cancer and cervical cancer. A divorced single mother of two, Segovia shares her Port Tampa, Florida home with her 10 year-old son Azaiah and 21 year-old son Christian. Her elder son has Down Syndrome; he cannot speak or bathe himself, and he has had heart surgery and a kidney transplant, reports the St. Petersburg Times.

My first Balto recut! I'm thinking about making other ones for other movies too. Taking the clips from the Universal movie Balto I came up with a little story. The story is this:
Balto and Jenna are in love, of course, but Steele wants Jenna. So the two fight and Balto comes out as the winner. Kinda like the movie but its just about the mushy love stuff.;)

The song is from Pirates of the Caribbean At World's End. Its one of the last scenes, which is my favorite out of the movie. The song is beautiful, Hans Zimmer is a genious! xD He did make the music for many of my favorite movies such as POTC, Balto and Spirit: Stallion of the Cimarron.

Here's one dog you probably won't find begging grill-side any time soon.

Smokey, a 12-week-old chihuahua puppy, ended up with a large barbecue fork in his brain after the utensil snapped in half on the grill, flew through the air, and impaled the poor puppy's head, reports the Telegraph. The terrified pup then ran off into the woods, where he hid for two days.

When his owner Hughie Wagers finally found him, Smokey was taken straight to the Cumberland Valley Animal Hospital, in London, Kentucky, where Michelle Duncum was on duty. Duncum said, "[W]hen he brought him in we couldn't believe our eyes."

X-rays showed that the fork was actually in the dog's brain, so the vet, Dr. Keaton Smith, only gave Smokey a 50/50 chance of surviving its removal. The operation itself only took about 30 seconds -- they just shaved Smokey's head and pulled the fork out. Thankfully the pint-sized pup is recovering wonderfully.

"His nerve endings around the eye still seem to be a little slow but I think that will heal over time," said Smith. "He really is a little miracle."

Relator challenges the designation of her dogs as "dangerous animals" under the St. Paul Legislative Code, arguing that (1) she was deprived of her due process rights, (2) the hearing officer‟s decision was unsupported by substantial evidence and was 2

arbitrary and capricious, and (3) the definition of "dangerous animal" in the St. Paul Legislative Code is preempted by state law. We affirm.

FACTS

In October 2007 a St. Paul police officer responded to a report that a woman and a 14-year-old girl were chased and bitten by two dogs. One victim was bitten on her right knee and upper left hamstring, and the other was bitten on her upper left thigh. The officer described both bites as two or three inches in length and looking like "scratch marks." A family member of the victims, B.H., who tried to scare away the dogs, also was bitten by one of the dogs, resulting in a "small scrape" on his knee about one-and-one-half inches long. The officer filed an incident report in which he reported that each of the three victims suffered an "apparent minor injury" as a result of the dog bites. The dogs were subsequently identified as two boxers, named Sadee and Brutis, owned by relator Malisa May Brunotte.

Relator‟s dogs were seized on October 10, 2007. Respondent City of St. Paul, Office of Safety & Inspections, addressed two letters to relator, also dated October 10, 2007, notifying her that her dogs were declared "dangerous animals" under the St. Paul Legislative Code (SPLC). St. Paul, Minn., Legislative Code § 200.12(a)(1), (2) (2007). The letters informed her that she had until October 25, 2007 to request a Dangerous Animal Seizure Hearing. Relator requested a hearing, which was held on October 22, 2007.

At the hearing, B.H. testified that he was in the basement of his nephew‟s house when one of the victims ran inside and told him that she and her companion had been 3

bitten by dogs. He came outside, saw one dog, and tried unsuccessfully to shoo it away. In an attempt to prevent it from biting, he grabbed the dog by the head when a second dog approached. One of the dogs bit B.H. on his left knee but he did not know which dog bit him. B.H. admitted that he had been drinking alcohol at the time of the incident. The female victims did not testify at the hearing.

Relator testified that on the date in question her dogs got loose when she took them outside. While looking for her dogs, she encountered one of the female victims who reported that the dogs had bitten her. Relator testified that the female victims had marks that looked like scratches, but that B.H.‟s knee looked like a "big chunk was taken out of [it], like he had fallen." Relator testified that she then saw one of her dogs being chased down a hill by two men, one carrying a chair and the other carrying a dowel. Relator also testified that she took good care of her dogs and that neither of them acted aggressively before the incident. Relator offered three letters as evidence of her dogs‟ temperament and history, but the hearing officer rejected two of the letters because they did not contain addresses for the authors and one of them contained the author‟s typed name but no signature. The hearing officer accepted a third letter by an author who also testified.

In November 2007 the hearing officer issued Dangerous Animal Notification/Agreements for each dog, informing relator that the dogs were determined to be dangerous animals and that relator had to meet several conditions to prevent her dogs from being destroyed. Thereafter, relator (1) procured muzzles and a secure outdoor-cabling system, (2) posted her residence with two dangerous-animal warning signs, 4

(3) had microchips implanted in her dogs, (4) affixed dangerous-animal tags to her dogs‟ collars, (5) provided a certificate of liability insurance to the city, (6) purchased two St. Paul lifetime dog licenses, (7) registered her dogs with Ramsey County, and (8) paid two annual registration fees. As a result of meeting these conditions, relator‟s dogs were returned to her in early December 2007. Relator initiated certiorari appeal challenging the determination that her dogs are dangerous animals.

D E C I S I O N

On certiorari review, the court is limited to considering whether (1) the agency had jurisdiction, (2) the proceedings were fair and regular, and (3) the agency‟s decision was unreasonable, oppressive, arbitrary, fraudulent, without evidentiary support, or based on an incorrect theory of law. Dietz v. Dodge County, 487 N.W.2d 237, 239 (Minn. 1992). Evidence is reviewed "only to determine whether it supports the findings of fact or the conclusions of law, and whether the municipality‟s decision was arbitrary or capricious." In re Dakota Telecomm. Group, 590 N.W.2d 644, 646 (Minn. App. 1999).

Relator claims that respondent deprived her of her due-process rights when it declared her dogs "dangerous animals" without (1) providing timely notice of evidence-authentication requirements that would be followed at the dangerous-animal hearing, and (2) conforming to the procedural requirement in the dangerous-animal ordinance that the hearing officer shall consider "all evidence pertaining to the temperament of the animal." Procedural due-process issues are reviewed de novo. Plocher v. Comm’r of Pub. Safety, 681 N.W.2d 698, 702 (Minn. App. 2004). 5

The due-process clause requires that deprivations of life, liberty, or property by adjudication be preceded by adequate notice and meaningful opportunity to be heard. Mathews v. Eldridge, 424 U.S. 319, 333, 96 S. Ct. 893, 902 (1976); Goldberg v. Kelly, 397 U.S. 254, 267, 90 S. Ct. 1011, 1020 (1970). While due process requires "the government to afford notice and a meaningful opportunity to be heard" before property is seized, United States v. James Daniel Good Real Property, 510 U.S. 43, 62, 114 S. Ct. 492, 505 (1993), the concept of due process is "flexible and calls for such procedural protections as the particular situation demands," Am. Dog Owners Ass’n v. City of Minneapolis, 453 N.W.2d 69, 71 (Minn. App. 1990) (quotation omitted).

To determine whether an individual‟s right to procedural due-process has been violated, a reviewing court first determines whether a protected liberty or property interest is implicated and then determines what process is due by applying a balancing test. Sweet v. Comm’r of Human Servs, 702 N.W.2d 314, 320 (Minn. App. 2005) (citing Mathews, 424 U.S. at 332, 335, 96 S. Ct. at 901, 903), review denied (Minn. Nov. 15, 2005). Dogs are personal property under Minnesota law. Corn v. Sheppard, 179 Minn. 490, 492, 229 N.W.2d 869, 870 (1930). We therefore conclude that a protected property interest is implicated and proceed to apply the Mathews balancing test. The Mathews test requires this court to consider: (1) "the private interest that will be affected by the official action"; (2) "the risk of an erroneous deprivation of such interest, through the procedures used, and the probable value, if any, of additional or substitute procedural safeguards"; and (3) "the government‟s interest, including the function involved and the 6

fiscal and administrative burdens that the additional or substantive procedural requirements would entail." Id.

Private Interest Affected

The first part of the Mathews test considers the private interest that will be affected by the action. Mathews, 424 U.S. at 335, 96 S. Ct. at 903. Relator asserts that her private interest in her dogs is significant because she provides care for her dogs and her children are attached to them. Relator argues that the private interest at issue is her "freedom and ability to provide a quality of life for her children, herself, and her dogs." But in American Dog Owners, we evaluated a procedural due-process challenge to an ordinance similar to that at issue in this case and concluded that "[p]rivate parties have little interest in harboring animals that may be dangerous." 453 N.W.2d at 71. Despite relator‟s contention that her dogs are not dangerous and that the city‟s dangerous-dog declarations have imposed significant financial and emotional costs upon her, we conclude, as in American Dog Owners, that relator has little interest in harboring dogs that may be dangerous. Thus, the first Mathews factor weighs against relator.

Risk of Erroneous Deprivation of Property Interest

The second Mathews factor is the risk, if any, of an erroneous deprivation of relator‟s property and the possible value of additional safeguards. Mathews, 424 U.S. at 335, 96 S. Ct. at 903. Relator argues that she was erroneously deprived of her property rights because she had no notification of the "evidence authentication requirements" that applied to the hearing, and that as a result, two letters she submitted as evidence of her dogs‟ temperament were rejected by the hearing officer. The primary function of notice 7

is to inform a party of how government action affects the party‟s interests. Schulte v. Transp. Unlimited, Inc., 354 N.W.2d 830, 834 (Minn. 1984). Notice is adequate if it communicates the adverse consequences of governmental action. Id. Notice is inadequate if it fails to communicate the interest at stake or is actively misleading. Plocher, 681 N.W.2d at 705.

Here, the notices sent to relator informed her that her dogs shall be seized, that she had the right to request a hearing, and that "[f]ailure to respond will result in an order for the destruction of the animal." Although the notices contain no references to evidentiary rules, they satisfy the requirement that they communicate the interest at stake and the adverse consequences of governmental action. We conclude that the notices were sufficient to satisfy relator‟s procedural due-process rights.

Relator also argues that she was erroneously deprived of her property rights because the hearing officer failed to consider "all evidence" pertaining to the dogs‟ temperament as required by SPLC section 200.12(c)(1)(d). St. Paul, Minn., Legislative Code § 200.12(c)(1)(d) (2007). Section 2.15 of the SPLC states that the rules of statutory construction established in the Minnesota Statutes shall generally apply to the interpretation of the code. St. Paul, Minn., Legislative Code § 2.15 (2008). Legislative intent controls the interpretation of statutes, Minn. Stat. § 645.16 (2008), and courts may presume that the legislature did not intend an absurd or unreasonable result, Minn. Stat. § 645.17 (1) (2008). Relator‟s interpretation of SPLC section 200.12(c)(1)(d), that it requires a hearing officer to consider all evidence, including unreliable or irrelevant evidence, would lead to an absurd result. We therefore reject relator‟s interpretation of 8

SPLC section 200.12(c)(1)(d), and conclude that the second Mathews factor weights against her.

Relator‟s argument that she was erroneously deprived of her rights to her dogs because the hearing officer did not consider "all evidence pertaining to the temperament of the animal" as required by SPLC section 200.12(c)(1)(d) is also colorable as a separate and distinct argument from her due-process challenge. A city‟s failure to follow its own procedural requirements may render its actions void or voidable. See Hamline-Midway Neighborhood Stability Coal. v. City of St. Paul, 547 N.W.2d 396, 399 (Minn. App. 1996) (holding that a city‟s failure to follow its own ordinance in issuing a license without a public hearing rendered its actions voidable), review denied (Minn. Sept. 20, 1996). But, because we conclude that SPLC section 200.12(c)(1)(d), does not require a hearing officer to consider all evidence, regardless of its reliability, we determine that the hearing officer did not violate the city‟s procedural requirements in rejecting the two letters.

Government Interest

The third Mathews factor considers the government‟s interest, including the fiscal and administrative burdens that the additional procedural requirements would involve. Mathews, 424 U.S. at 335, 96 S. Ct. at 903. As this court stated in American Dog Owners, a city "has a high interest in taking appropriate measures for animal control." 453 N.W.2d at 72. Relator provides no authority for the proposition that respondent has a legal duty to provide notice of its rules of evidence nor does it appear that respondent has adopted formal rules of evidence. We conclude that the third Mathews factor weighs 9

against relator and her procedural due process challenge fails. See Am. Dog Ass’n, 453 N.W.2d at 71-72 (concluding that a procedural due-process challenge fails where none of the Mathews factors weighed in favor of the party making the challenge).

II.

Relator argues that respondent‟s declaration that her dogs were "dangerous animals" was not supported by substantial evidence. "Substantial evidence" means (1) "such relevant evidence as a reasonable mind might accept as adequate to support a conclusion"; (2) "more than a scintilla of evidence"; (3) "more than „some evidence‟"; (4) "more than any evidence"; and (5) "evidence considered in its entirety." Reserve Mining Co. v. Herbst, 256 N.W.2d 808, 825 (Minn. 1977).

Relator argues that the hearing officer‟s conclusion was unsupported by substantial evidence because B.H. admitted that he was drinking alcohol at the time of the incident, apparently challenging the hearing officer‟s reliance on B.H.‟s testimony as credible. The hearing officer did not mention B.H.‟s alcohol use in her decision. Determinations of witness credibility are "the sole province of the finder of fact." Citizens Nat’l Bank of Madelia v. Mankato Implement, Inc., 441 N.W.2d 483, 485 (Minn. 1989). This court will not disturb the hearing officer‟s credibility determination about B.H.‟s testimony. Relator also argues that the hearing officer‟s conclusion was unsupported by substantial evidence because no photographic evidence exists to substantiate any of the victims‟ injuries. But the record contains substantial evidence about the victims‟ injuries in the form of B.H.‟s testimony and the police report. Even relator testified that she saw two marks behind the right knee of one of the female victims 10

and that B.H.‟s knee looked "like a big chunk was taken out of [it]." The record contains substantial evidence supporting the hearing officer‟s findings in this case, and we therefore affirm these findings.1 Relator also argues that because a police report describes the victims‟ injuries as "apparent minor injury," the hearing officer‟s conclusion was unsupported by substantial evidence. Relator suggests that "substantial evidence" requires a police report of a dog tearing flesh or limb from a victim or biting deeply into a victim‟s skin, or credible witness testimony that a dog shook and would not release a victim‟s limb, or medical or photographic evidence of injuries. But the plain text of the SPLC does not indicate that serious injury, or indeed any injury, must result from the attack in order to support a "dangerous animal" designation. Section 200.12(a)(2) of the SPLC defines "dangerous animal" as one that "[w]ithout provocation engaged in any attack on any person under circumstances which would indicate danger to personal safety." We conclude that relator‟s argument about the requirement of substantial evidence lacks merit.

Relator further argues that respondent‟s declaration that her dogs were "dangerous animals" was not supported by substantial evidence because the attacks were provoked. Indeed, a "dangerous animal" is one that engaged in any attack without provocation. Id. Relator cites B.H.‟s testimony that that he "grabbed" and "had the head" of one of the dogs and guessed that the other dog "came in the defense of his partner." Respondent argues that B.H. did not provoke the attack on him because he acted only with intent to 11

prevent the dogs from attacking anyone else besides the female victims. Relator‟s argument does not address the evidence in the record that the dogs‟ attacks on the two female victims were unprovoked. See Hannan v. City of Minneapolis, 623 N.W.2d 281, 286 (Minn. App. 2001) (concluding that evidence in the record strongly suggesting that "several, if not all, of the dog‟s attacks were unprovoked" justified the hearing officer‟s affirmation of an order to destroy a dangerous dog).

Relator also asserts that when two men with a dowel and a chair chase dogs from the scene of a dog attack, as relator testified that she witnessed, it is reasonable to conclude that the dogs were provoked at the scene of the attack. This assertion is illogical, because reasonable persons might take similar actions in response to an unprovoked dog attack. Relator cites Bailey by Bailey v. Morris, 323 N.W.2d 785, 787 (Minn. 1982), in which the jury found provocation where a minor, despite being warned, approached a growling dog with pups that other children would not approach. But the Bailey court considered the conduct of a dog-bite victim prior to the attack, and relator‟s attempt to apply Bailey to impute provocation from the actions of other people after the attack is unconvincing. We therefore reject relator‟s argument that the hearing officer‟s decision was not supported by substantial evidence.

III.

Relator argues that respondent‟s declaration that her dogs were "dangerous animals" was arbitrary and capricious. A decision may be deemed arbitrary and capricious only if: (1) it relied on factors not intended by the ordinance; (2) it entirely failed to consider an important aspect of the issue; (3) it offered an explanation that 12

conflicts with the evidence; or (4) it is so implausible that it could not be explained as a difference in view or the result of the city‟s expertise. Minnegasco v. Minn. Pub. Utils. Comm’n, 529 N.W.2d 413, 418 (Minn. App. 1995), rev’d on other grounds, 549 N.W.2d 904 (Minn. 1996).

Relator first argues that the hearing officer‟s conclusion was arbitrary and capricious because the hearing officer failed to consider the less punitive "potentially dangerous" designation for her dogs. Under SPLC section 200.11, a "potentially dangerous animal" is one that has, "[w]hen unprovoked, bitten a human or a domestic animal" or "[w]hen unprovoked, chased or approached a person upon the streets, sidewalks, or any public or private property, other than the animal owner‟s property, in an apparent attitude of attack." St. Paul, Minn., Legislative Code § 200.11(a)(1),(2) (2007). In contrast, under SPLC section 200.12(a)(2), a "dangerous animal" is one that "without provocation engaged in any attack on any person under circumstances which would indicate danger to personal safety." "Dangerous animal" is defined more broadly than "potentially dangerous animal" because the conduct of a "dangerous animal" is not limited to biting and need not occur on property other than the animal owner‟s property. Here, the hearing examiner determined that relator‟s dogs are "dangerous animals" based on the evidence that they attacked B.H. and the female victims without provocation under circumstances that indicate danger to personal safety. Relator provides no legal support for her argument that simply because the evidence would also support a declaration that her dogs are "potentially dangerous animals," the hearing officer was required to apply the less punitive ordinance. 13

Relator also argues that the hearing officer‟s decision was arbitrary and capricious because the hearing officer did not describe the victims‟ injuries using medical terms or assessment tools used by professionals. The hearing officer referred to the locations of the injuries in the decision and described them as "bites" and a "gash." While relator describes a number of methods by which a hearing officer may describe injury, such as the Dunbar Bite Level scale or by the terms used in Minnesota criminal statutes to describe bodily injury, she provides no legal support for her argument that a hearing officer acts arbitrarily and capriciously in not using these methods or in not using formal or technical terms rather than plain language to describe injuries. Thus, relator‟s argument lacks merit.

Relator further argues that the hearing officer‟s decision was arbitrary and capricious in that it failed to discern which dog, or whether both dogs, inflicted the injuries in the incident. The hearing officer observed that the dogs were originally seized as "dangerous animals" under SPLC section 200.12(a)(1) and (2), but concluded only that the seizure was justified without referring to the provision under which the seizure was justified. Respondent concedes that because the record does not show which dog, or whether both dogs, inflicted the injuries, it is insufficient to support a conclusion that the dogs are "dangerous animals" under SPLC section 200.12(a)(1), which defines a "dangerous animal" as one that has "[w]ithout provocation caused bodily injury or disfigurement to any person on public or private property." But respondent argues that the record is sufficient to support the hearing officer‟s declaration that the dogs are "dangerous animals" under SPLC section 200.12(a)(2), because a "dangerous animal" is 14

one that "[w]ithout provocation engaged in any attack on any person under circumstances which would indicate danger to personal safety." The definition does not require personal injury. In this case, substantial evidence shows that both dogs participated in the attack of the victims, even if only one caused the physical injuries. Relator therefore fails to show that the hearing officer‟s decision was arbitrary and capricious.

IV.

Relator argues that the hearing officer should have applied the statutory definition of "dangerous dog": a dog that "without provocation, inflicted substantial bodily harm on a human being on public or private property." Minn. Stat. § 347.50, subd. 2(1) (2006) (emphasis added). Relator cites section 2.18 of the SPLC, which states that "unless clearly in conflict with definitions, context, or provisions of this Code, or for some other reason clearly inapplicable, definitions established for the State of Minnesota by statute or caselaw shall apply to the Saint Paul Legislative Code." St. Paul, Minn., Legislative Code § 2.18 (2008). Relator argues that under SPLC section 2.18, because section 200.12(a)(1) of the SPLC contains the term "bodily injury" rather than "substantial bodily harm" in its definition of a dangerous animal, section 200.12(a)(1) is preempted by Minn. Stat. section 347.50.

But respondent has conceded that the terms of SPLC section 200.12(a)(1) are not applicable in this case, and relator ignores that SPLC section 200.12(a)(2) does not require "bodily injury" but only an attack that "would indicate danger to personal safety." Moreover, the supreme court addressed the local regulation of dangerous animals in Hannan, stating that "the legislature has neither expressly nor impliedly indicated that the 15

subject matter is solely a matter of state concern. In fact, state law expressly provides for local regulation." 623 N.W.2d at 285; see also Minn. Stat. §§ 347.53, .51, subd. 8 (2008) ("Any statutory or home rule charter city, or any county, may regulate potentially dangerous and dangerous dogs" as long as the regulations are not breed specific.). Keep me well nourished so that my body will have the fortitude that it needs to fight disease and energy to function.
Offer me my favorite foods to entice me to eat but honor my decision, should I choose not to eat.

Keep me well hydrated; for this will keep me in balance with the universe.

Keep me warm and comfortable. I will need to be bathed more frequently-maybe several times a day. My favorite bed and blanket gives me security and lets me feel safe. I want to smell fresh air and to feel the warmth of the sun on my face.
I want to hear the softness of your voice reassuring me of my importance in your life.

Let me stay active and continue to be a part of the family I love so dearly. I want to go for rides in the car, and long walks on the beach, and snuggle with you on the couch while we watch TV. Keep fun in our day.

Touch me. Your loving hands have fed me, played with me, comforted me and now give me strength. Linger just a little longer as you scratch my ear. Your touch lets me know you are there and gives me assurance that you care.

Those First 100 DaysProtecting wolves is one of five actions Earthjustice urges the new president to immediately take on behalf of the environment.

Judge Halts Drilling in UtahIn a major victory for the environmental community, a federal judge agreed to temporarily halt issuance of leases that would allow oil and gas drilling on some 100,000 acres of pristine Utah wildlands. The leases were hastily pushed through by the Bush administration without consideration of their irreparable environmental harm.

Opposing Western Energy StampedeEarthjustice is spearheading opposition to a wasteful, unproven energy-extraction plan that threatens more than two million acres of public land in Wyoming, Utah and Colorado. Two lawsuits filed last week charge the Interior Department and Bureau of Land Management with illegally rushing through a commercial oil shale and oil tar leasing program.

EPA to Limit Mercury from Cement KilnsAfter a decade of delay, the Environmental Protection Agency has agreed to adopt mercury air pollution limits for cement kilns. The settlement—representing a hard-fought victory for Earthjustice, its environmental allies and states—will regulate emissions from more than 150 cement kilns in nine eastern states. We'll continue to follow this issue, making sure EPA doesn't change its mind at the last minute.

Idaho Roadless Rule ChallengedThe Idaho roadless rule—a state rule set up under the Bush "roadless" rule—is being challenged in an Earthjustice lawsuit. Unlike the 2001 roadless rule, which actually protects our public lands and which Earthjustice has been defending since it went into affect, the Idaho rule removes protection for 400,000 acres of Idaho roadless lands and weakens protection for an additional 5 million acres of public national forest. The Idaho rule will more than triple road construction—up to 50 miles of new roads in 15 years—and almost double logging up to 15,000 acres. Much of the land in question is the last remaining habitat for rare wildlife including bull trout, lynx, wolverine, wolves and grizzly bears.

Suit Confronts Bush Timber GiveawayEarthjustice, filing on behalf of 13 conservation and fisheries protection organizations, is suing to overturn the Bush administration's eleventh-hour decision to nearly quadruple logging on public lands in western Oregon. The Western Oregon Plan Revision, known by the acronym WOPR, rezones 2.6 million acres of federal public forests in Oregon managed by the Bureau of Land Management. The timber giveaway flies in the face of numerous scientific studies concluding that these dramatic increases in logging will harm clean water and healthy streams, push wildlife toward extinction, contribute to global warming, and destroy much of Oregon's remaining old-growth forests.

Public Threatened by Weak Drilling StandardFrom coast to coast, weak federal clean air standards are leading to smoggier skies and more toxic air, an Earthjustice suit claims. The suit, filed last week, goes after the Environmental Protection Agency for failing to protect communities and the climate from air pollution emitted nationwide by oil and gas drilling.

Groups take on Industrial Air PollutionBy petition and lawsuit, conservation groups led by Earthjustice are seeking to strengthen air pollution controls affecting 48 industries—from chemical plants and refineries to paper mills and metal smelters. The actions follow a steady stream of court findings that Bush-era environmental rules and policies have blatantly violated federal law because of weak, delayed rules.

EPA Bows to Pressure over Smog RulesIn a major victory for environmental and public health advocates, the U.S. Environmental Protection Agency is proposing stronger anti-pollution measures in more than a dozen communities with unhealthy levels of smog. Earthjustice represented groups in the successful lawsuit, prompting the court order that led to EPA's proposal.

Sweet Settlement for Bitter Lake RefugeFour tiny, endangered creatures have been given a break through a settlement driven by an Earthjustice lawsuit. Last week, Judge Herrera of the U.S. District Court of New Mexico signed an agreement in which the Fish and Wildlife Service will reevaluate its decision not to designate Bitter Lake National Wildlife Refuge as critical habitat for four endangered invertebrates. Three of the four invertebrates—three snails and a freshwater shrimp—live nowhere else in the world. Despite pollution from oil and gas drilling operations, the FWS had declined to designate the refuge as critical habitat. In the face of the lawsuit, filed on behalf of WildEarth Guardians and Center for Biological Diversity, FWS agreed to revisit that decision. The new proposed rule is due out in March.

Foundation Honors Earthjustice ChairmanEd Lewis, chairman of the Earthjustice Board of Trustees, has been given the prestigious Wilburforce Foundation Leadership Award for his many contributions to conservation. "We all know how well-deserved this award is, recognizing Ed's conservation leadership as Earthjustice's board chair, as board chair of TREC, as a key player in land conservation in the Northern Rockies, and as a consultant and advisor to many organizations," said Earthjustice President Trip Van Noppen.

UPDATE: Bush Takes Parting Shot at Gray Wolves

Gray wolf pups. The new rule would allow Idaho and Montana to kill all but 450 gray wolves.

Dear Sharon,

I'm sad, but not surprised, to say that the Bush administration announced its decision yesterday to remove northern Rockies' gray wolves from the endangered species list.

This new rule would allow Idaho and Montana to kill all but 450 gray wolves—leaving a population that is too small to survive by almost any measure.

We're not taking this assault on gray wolves lying down.

In fact, because of support from folks like you, we're prepared to serve the U.S. Fish and Wildlife Service with a 60-day notice of intent to file suit to stop the wolf slaughter as soon as the decision is made official.

By ramming through this decision to delist the wolves—in its trademark contempt for science and the rule of law—the administration is allowing Idaho and Montana to kill nearly 1,000 wolves.

I want to reassure you that my team and I won't rest until we've secured long-term protections for the wolves. And Earthjustice is committed to not only seeing through this latest court fight, but also to reaching out to the Obama administration to establish protections that ensure a sustainable population of the gray wolves of the northern Rockies.

We want wolves to recover to the point where they can come off of the endangered species list—much like the success with the American bald eagle—but we want to see them come off under the right conditions.

This means taking steps to halt the current wolf population decline, increasing the population to at least 2,000-3,000 wolves, ensuring necessary connectivity among wolves throughout the northern Rockies, and creating a legal safety net for wolves that prevents states from killing hundreds of wolves after delisting.

We are committed to seeing this challenge through the end and ensuring that the gray wolves keep the protections necessary to their survival. And with your help, we will prevail.
